Drone Usage in the Village

At this time drones would not be allowed to be flown in village parks. Ordinance 70-29 states, No person shall fly a radio-controlled model airplane or helicopter in any park in the village, except in the areas specifically designated and posted for such purpose. There is no other village ordinance that would prohibit flying a drone in Waunakee; however, there are State and Federal restrictions listed below.

State of Wisconsin Statute 942.10 has restrictions on drone use: Whoever uses a drone, as defined in s. 175 (1) (a) with the intent to photograph, record, or otherwise observe another individual in a place or location where the individual has a reasonable expectation of privacy is guilty of a Class A misdemeanor. If convicted of a class A misdemeanor, a person could face up to 9 months in jail and fines up to $10,000.00

The Federal Aviation Administration has restricted the following:

Don't fly near manned aircraft.
Don't fly beyond line of sight of the operator.
Don't fly an aircraft weighing more than 55 lbs. unless it's certified by an aeromodeling community-based organization.
Don't fly contrary to your aeromodeling community-based safety guidelines.
Don't fly model aircraft for payment or commercial purposes.
